TERMS AND CONDITIONS OF SALE – ALIBI

These Terms and Conditions of Sale ("Terms") govern the purchase of products sold through the website www.alibilove.it (the "Website").

 


 

1. Website Owner and Contacts

1.1 The Website is managed by Alibi di Lisa Brunetti, with registered office in Via Tevere, 14 – 65015 Montesilvano (PE), Italy, VAT ID 02394540682, Tax Code BRNLSI95M60G482R (hereinafter "Alibi" or "Seller").

1.3 The WhatsApp channel is provided for quick inquiries and informal assistance; for formal communications (e.g., withdrawal, complaints, legal requests), the use of email/PEC at the addresses above is always recommended.

 


 

2. Scope and Definitions

2.1 These Terms regulate the distance selling of products through the Website to:

  • Consumers, i.e., natural persons who purchase for purposes unrelated to their business or professional activity;

  • Professional Clients, i.e., entities that purchase in the exercise of their business activity (B2B).

2.2 Some protections (e.g., the right of withdrawal "cooling-off period") apply only to Consumers.

2.3 Sales contracts concluded through the Website are distance contracts pursuant to Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (E-commerce).

2.4 Alibi sells and ships to Italy and the European Union.

 


 

3. Handcrafted Products and Information

3.1 Alibi creates and sells handcrafted metal products and related items, as described in the product sheets.

3.2 Photos and descriptions are for illustrative purposes. As these are handcrafted items, slight variations in finish, texture, or tone are possible (also due to differences in screen display). Such variations do not constitute a defect if they do not affect the conformity of the good.

3.3 If a product is unavailable after the order, Alibi will promptly inform the customer and offer a refund or an alternative solution (if accepted by the customer).

 



4. Prices, Tax Regime, and Invoice

4.1 Prices are expressed in Euro (€) and are those indicated on the Website at the time of the order.

4.2 Flat-rate tax regime: Alibi operates under a flat-rate tax regime. Therefore, VAT is not charged under the terms provided by the regime, and the tax documentation may bear the wording provided by the applicable legislation (e.g., VAT exemption pursuant to Law 190/2014, where pertinent).

4.3 Shipping costs are indicated separately in the checkout and order summary (see Art. 8).

4.4 Invoice upon request: the invoice is issued only upon customer request.

To request it, the customer must correctly enter billing details during checkout or send them via email to assistenza@alibilove.it within 24 hours of the order, indicating the order number and complete details (recipient, address, Tax Code and/or VAT ID, any SDI/PEC where applicable).

Late requests may not be fulfilled.

 


 

5. Account and Customer Obligations

5.1 The customer can purchase as a guest or register an account.

5.2 The customer guarantees that the entered data is complete and truthful and undertakes to update it.

5.3 The customer is responsible for the confidentiality of credentials and activities carried out through their account.

 


 

6. Conclusion of the Contract

6.1 The customer selects the products, enters the required data, and completes the order by following the Website's procedure.

6.2 Submitting the order constitutes a contractual proposal by the customer.

6.3 The contract is concluded when the customer receives the order confirmation email, containing a summary of the products, prices, costs, delivery address, and key information.

 


 

7. Payments

7.1 Payments are accepted through the methods available on the Website and managed by integrated providers.

7.2 Alibi does not store full card data: payments are managed by their respective providers according to their terms and security standards.

7.3 In case of non-payment or unsuccessful payment, the order will not be processed.

 


 

8. Shipping, Delivery, Costs, and Times

8.1 Courier: GLS.

8.2 Shipping costs (unless different promotions are indicated at checkout):

  • Italy (peninsula): € 7.00

  • Italy (islands): € 10.00

  • European Union: € 30.00

8.3 Free shipping: not provided.

8.4 Order preparation times:

  • standard products: 5 business days;

  • customized products: 15 business days.

8.5 Delivery times depend on the destination and courier logistics; any estimates shown on the Website are indicative.

8.6 Upon delivery, the customer must check the integrity of the packaging. Any damage/anomalies must be reported to the courier and communicated to Alibi via email (with photos, if possible) as soon as possible.

8.7 For Consumers, the risk of loss or damage passes at the moment the Consumer (or a third party designated by them) acquires physical possession of the good.

 


 

9. Right of Withdrawal (Consumers only)

9.1 The Consumer has the right to withdraw from the contract, without stating a reason, within 14 (fourteen) days.

9.2 The period starts:

  • from the day of delivery of the good; or

  • in the case of multiple goods delivered separately, from the day of delivery of the last good.

9.3 To exercise the right of withdrawal, the Consumer must send an explicit communication via the appropriate form to be downloaded HERE:

9.4 Return: the Consumer must return the goods within 14 days from the communication of withdrawal to the following address:

9.5 Return costs: borne by the customer.

9.6 The good must be returned intact, unused beyond what is necessary to ascertain its nature and characteristics, complete with any accessories and, where possible, with original packaging.

9.7 Refund: Alibi will refund the payments received for the products subject to withdrawal within 14 days of receiving the withdrawal communication. Alibi may suspend the refund until receipt of the goods or until proof of shipment, if earlier.

9.8 The refund will be made using the same payment method used by the customer, unless otherwise agreed.

 


 

10. Exclusions from Withdrawal

10.1 The right of withdrawal is excluded in the cases provided for by art. 59 of the Consumer Code, including goods made to measure or clearly personalized.

10.2 For Alibi, withdrawal is excluded for handcrafted products personalized with a name, including, by way of example, "dog" and "cat" items with a name (and any item made to the customer's specific request).

10.3 The exclusion will also be indicated in the product sheet and/or during the purchase procedure.

 


 

11. Legal Guarantee of Conformity (Consumers)

11.1 Products sold to Consumers are covered by the legal guarantee of conformity for a duration of 2 years from delivery.

11.2 In case of a lack of conformity, the Consumer has the right, free of charge, to have the conformity restored by repair or replacement, where possible and not excessively burdensome, or, in the cases provided for, to a price reduction or termination of the contract.

11.3 To open a warranty assistance request, the customer must contact info@alibilove.it indicating the order number, description of the problem, and attaching useful photos/videos.

11.4 The warranty does not cover damage due to improper use, impacts, tampering, normal wear and tear, lack of maintenance, or unauthorized third-party interventions.

 


 

12. Professional Clients (B2B)

12.1 For purchases made by Professional Clients:

  • the Consumer's right of withdrawal does not apply;

  • any remedies and guarantees follow the provisions of the Civil Code and/or agreements between the parties.

12.2 The Professional is responsible for correctly entering tax data (VAT ID, SDI/PEC where applicable) and for any invoice request within the indicated terms.

 


 

13. Limitation of Liability and Force Majeure

13.1 Alibi is not liable for delays or non-performance due to force majeure or uncontrollable circumstances (e.g., strikes, exceptional weather events, logistical disruptions).

13.2 Within the limits permitted by law and subject to willful misconduct or gross negligence, Alibi's liability is limited to the amount paid for the disputed order.

 


 

14. Intellectual Property

14.1 Trademarks, logos, texts, images, and content of the Website are owned by Alibi or used under license. Unauthorized reproduction is prohibited.

 


 

15. Privacy and Cookies

15.1 The processing of personal data is governed by the Privacy Policy and Cookie Policy available on the Website.

 


 

16. Complaints, Applicable Law, and Competent Court

16.1 For complaints and assistance: info@alibilove.it or brunettilisa9@pec.it.

16.2 These Terms are governed by Italian law.

16.3 If the customer is a Consumer, disputes are subject to the court of the place of residence or domicile of the Consumer, within the mandatory limits of the law.

16.4 For Professional Clients, the Court of Pescara has exclusive jurisdiction, unless otherwise agreed in writing.
